Udyam Registration (Formerly Udyog Aadhaar)

Overview

Udyam Registration for MSMEs:

Udyam Registration is the government registration process for micro, small, and medium enterprises (MSMEs) in India. It is accompanied by a recognition certificate and a unique Udyam Registration Number, and is intended to promote the ease of doing business for MSMEs by simplifying the regulatory framework.

Udyam replaced the earlier Udyog Aadhaar Memorandum (UAM) system with effect from 1 July 2020. Enterprises holding an old Udyog Aadhaar number are no longer recognised as MSMEs and must complete a fresh Udyam Registration. Vinay Associate assists both new enterprises and existing Udyog Aadhaar holders through the process.

Udyam Registration Certificate:

The Udyam Registration Certificate is issued online on successful registration and carries a permanent Udyam Registration Number along with a dynamic QR code. It formalises the enterprise as a legitimate business recognised by the Government of India and serves as the sole valid proof of MSME status. The certificate has lifetime validity and does not require renewal, though the enterprise must keep its details updated where investment, turnover or business structure changes.

Reasons to Register Under Udyam:

  • Simplified Registration Process: Udyam offers a paperless, self-declaration based online registration, making it simpler and quicker than the traditional MSME registration processes which were lengthy and cumbersome.
  • Access to Credit: Registration makes businesses eligible for availing of credit guarantees from banks and financial institutions under various governmental schemes aimed at business development.
  • Eligibility for Government Benefits: Enterprises registered under Udyam can avail themselves of numerous benefits such as eligibility for government subsidies, exemptions under direct tax laws, and preferential treatment in procuring government tenders.
  • Ease of Getting Approvals and Licenses: The Udyam Registration Number helps enterprises reduce the hassle of obtaining clearances and approvals from regulatory bodies.
  • Protection against Delayed Payments: Registered MSMEs enjoy legislative protection against delayed payments from their buyers and the right of interest on delayed payments, with conciliation, arbitration and settlement of disputes to be done in minimum time.
  • Market Promotion Subsidy Eligibility: MSMEs can claim subsidies for expenses incurred to promote their business including participation in foreign expos, trade fairs, and more.

Documents Required for Registration:

  • Aadhaar Number: The Aadhaar number of the individual owner, or the managing partner, karta, or authorised signatory in the case of a partnership, HUF, company or other entity.
  • PAN and GSTIN: PAN of the enterprise is mandatory, and GSTIN is required wherever the enterprise is liable to be registered under GST. Investment and turnover figures are drawn directly from these records.
  • Bank Details: Details of the bank account associated with the business including IFSC code and account number.
  • Personal, Business, and Communication Details: Information such as the entrepreneur's name, gender, official address, email, and contact numbers.
  • Business Details: Location of the plant(s), the main line of business activity, the applicable NIC code, and the number of persons employed.

Registration Process:

  1. Visit the Official Udyam Portal: The first step involves visiting the official portal (udyamregistration.gov.in) designated for Udyam Registration, and selecting whether this is a new registration or a re-registration by a previous Udyog Aadhaar holder.
  2. Enter Aadhaar and Validate It: Input the Aadhaar number and name as per Aadhaar, then submit this information to generate a One-Time Password (OTP) that will be sent to the Aadhaar-linked mobile number.
  3. Verify PAN: Select the type of organisation and enter the PAN of the enterprise for validation against the Income Tax database.
  4. Fill in the Application Form: Proceed to complete the application, including the social category, enterprise type, postal address, commencement date, and previous registration details, if any.
  5. Bank and Business Details: Further details about the bank and specifics of the business need to be entered, such as the main business activity, the NIC code for the activity, and the total number of people employed. Investment and turnover are fetched automatically from linked PAN and GST records to determine the enterprise classification.
  6. Final Submission and Certificate: After ensuring all information is accurate, submit the form. On successful verification, the Udyam Registration Number is allotted and the e-certificate is issued, which can be used for accessing various services and subsidies provided by the Ministry of MSME.
