Section 25, Trade Marks Act 1999 Ten-Year Term, Renewable Indefinitely

A registration runs for ten years from the date of application and may be renewed for successive ten-year periods without limit. Renewal is filed on Form TM-R, and the application may be made up to a year before expiry to avoid any break in protection.

If a renewal is missed Grace Period and Restoration

A late renewal is permitted within six months of expiry on payment of a surcharge. Beyond that, restoration may be sought between six and twelve months from expiry. Once a mark is removed from the register, it becomes available for others to claim.

Using the marks ™ and ® Symbols

The ™ symbol may be used from the date the application is filed, while the ® symbol may only be used once the Registry has issued the registration certificate. Applications are advertised in the Trade Marks Journal, opening a window during which third parties may file opposition.
